TRINITY WARRANTY

Manufacturer Limited Warranty. 

Trinity Labs USA LLC (“Trinity”) warrants, subject to the limitations described below, the Products (defined below in the section titled “Which Trinity Products Are Covered By The Limited Warranty?”) against defects in materials and workmanship under normal use.   This limited warranty (“Limited Warranty”) is: (i) solely applicable to the original end-user purchaser who bought the Product new from an authorized Trinity retailer located in the United States or Trinity-operated webstore at www.mytrinitypods.com for delivery to a purchaser in the United States (each, a “Trinity Store”); and (ii) is non-transferable and non-assignable.  


Important Notice.

This Limited Warranty is your sole and exclusive remedy against Trinity, including its affiliates, subsidiaries, related entities, associates, dealers, agents, suppliers, and their respective shareholders, officers, directors, managers, members, owners, employees, licensors, and assigns (collectively, the “Trinity Group”), and constitutes the Trinity Group's sole and exclusive liability with respect to Product defects. This warranty replaces and supersedes all other Trinity Group warranties, whether express or implied, in regard to the Products, whether oral, written, statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties, or other terms as to Product quality or fitness for a particular purpose. To the extent permitted by applicable law(s), the Trinity Group does not assume any liability for any loss of profit, loss of use of Products, functionality, loss of business, loss of contracts, loss of revenues, loss of savings, increased cost or expenses, indirect, incidental, special, punitive, or consequential loss or special loss or damage. The Trinity Group's liability shall be limited to the purchase value of the Product.

This Limited Warranty applies only to defects in the Products .  The Trinity Group does not make any warranty related to any use or efficacy of the Product or any product that may be used or consumed in conjunction with the Product. It is not intended to limit, exclude, or otherwise affect any rights you may have against a non-Trinity Group entity, or a non-Trinity Group affiliate and subsidiary, that sold the Products to you, if that entity has breached its sales contract with you. Trinity does not authorize any retailer, reseller, distributor, agent, or other third party to extend, expand, or modify this Limited Warranty, nor to make any representation or commitment that is binding on the Trinity Group. The Trinity Group is not responsible for, and will not be bound by, any additional warranties, obligations, or promises made by non-Trinity Group parties.


What Does This Limited Warranty Cover?

Each Product is eligible for the Limited Warranty beginning on the date of delivery to the purchaser. “Delivery” refers to the date the Product is received by the purchaser, either by physical receipt in person (e.g., handoff at a store or pickup location) or by successful completion of shipment to the purchaser’s designated address.

This Limited Warranty does not cover a purchase made outside of the US. 

Trinity does not warrant glass, atomizers, normal wear and tear, or damages caused by accident or abuse. 

 

Product Registration.

In order to be eligible for the benefits described in this Limited Warranty, each Product must be registered with Trinity within 30 days of purchase by the original purchaser. Proof of purchase must be provided. To register your Product, click the following link  mytrinitypods.com/support and complete the Product Registration form.

Personal information provided during Product registration is protected in accordance with Trinity’s Privacy Policy, available at www.mytrinitypods.com/privacy. Data will only be used for warranty and support purposes.

Which Trinity Products Are Covered By The Limited Warranty?

  • Trinity Smart Battery 
  • Concentrate Pod + 2 Coils – empty pod (unfilled)
  • Flower Pod – empty pod (unfilled)
  • 510 Thread Adapter Pod 
  • Replacement Silicone Insert + 4 Coils (For Concentrates)
  • Trinity Mini Smart Battery

The list of eligible Trinity products provided above (each a “Product,” and together, the “Products”) is not exhaustive and may be modified at any time by Trinity in its sole discretion. For the most current and complete list of Products covered under our Limited Warranty policy, check Trinty Product list at www.mytrinitypods.com. The list may be updated from time to time at Trinity’s sole discretion and without prior notice.


How Long Is Your Trinity Product Warranted? 

  • Trinity Smart Battery - 2 Years
  • Concentrate Pod + 2 Coils - 60 days empty pod (unfilled)
  • Flower Pod - 60 days empty pod (unfilled)
  • 510 Thread Adapter Pod - 60 days
  • Replacement Silicone Insert + 4 Coils (For Concentrates) - 60 days
  • Trinity Mini Smart Battery - 2 Years
  • Repaired, replaced, and refurbished Product: The longer of the remainder of the original applicable Limited Warranty Period or 30 days.


The time periods described above, as applicable to each Product, the “Limited Warranty Period”.


This Limited Warranty Shall NOT Apply to Certain Products (or other products) as Follows:

  • To any Products that are resold by the purchaser or that are purchased from an entity other than a Trinity Store. Trinity does not authorize resellers to sell Products on online marketplaces such as Amazon, eBay, Walmart.com, or other unauthorized third-party marketplace platforms. 
  • Purchasers should note that atomizers are replaceable parts with an expected life of 1 – 3 months, depending on usage, and they require regular cleaning to maintain functionality. Please see www.mytrinitypods.com/pages/support for support.  This Limited Warranty shall not apply to atomizers.
  • If the Product has been used with aftermarket accessories such as mouthpieces that have not been approved or endorsed by Trinity.
  • If Trinity, in its absolute and sole discretion, determines that the Product has been improperly used, altered or tampered with in any way. Purchaser assumes the risk or liability for loss arising from misuse, alteration of a Product or failure to follow instructions provided in the user manual. Intentionally opening up or disassembling your Product in any way will void your warranty.
  • To any pods , including, but not limited to the following:
    • Grandaddy Purp Sauce Smart Pod 2G
    • Tropical Express Sauce Smart Pod 2G
    • White Widow Sauce Smart Pod 2G
    • Northern Lights Sauce Smart Pod 2G
    • Strawberry Cough Sauce Smart Pod 2G
    • Watermelon Gelato Sauce Smart Pod 2G
    • Sauce + Diamonds Sauce Smart Pod 2G 

For the purpose of clarity, the Trinity Group does not offer any warranty related to pre-filled pods.  Such pre-filled pods may only be returned to the applicable retailer, and any return may be subject to such retailer’s return and warranty policy.


This Limited Warranty Further Shall Not Apply To Any Damage, Defect, Or Failure to any Product Resulting From:


  • Exposure to moisture, extreme thermal or environmental conditions.
  • Damage caused by improper maintenance or storage, accident, abuse, misuse, flood, fire, earthquake, or other external causes.
  • Damage caused by concentrates, the concentrate adapter, or waxes.
  • Normal performance of degradation of batteries, accessories, wear and tear of hinges, or mouthpieces.  Normal battery degradation includes a gradual reduction in capacity over time, typically up to 20% after one year of regular use and shall continue thereafter.
  • Normal wear and tear.
  • Damage caused by operating the Product outside the permitted or intended use as described by Trinity.
  • A Product or part that has been modified to alter functionality or capability. 
  • Cosmetic damage, including but not limited to scratches, dents, drops, and broken pieces.
  • Any Product where the serial number has been tampered with, erased, removed, defaced, altered, obscured, rendered illegible, or determined by Trinity to be counterfeit or otherwise inauthentic.
  • Usage of accessories/attachments not authorized or recommended by Trinity.
  • Any loss or theft of a Product. 
  • Any non-Trinity products.
  • If warranty claim is made fraudulently or by misrepresentation.
  • Trinity expressly reserves the right, in its sole and reasonable discretion, to determine whether any claimed defect, damage, or performance issue is covered by this Limited Warranty or excluded under any of the foregoing provisions.

 

Please Note:

Trinity may request additional details about the applicable Product, including pictures or videos and Trinity may attempt to troubleshoot common issues before approving warranty service. All Products approved for warranty service must be returned to Trinity before a replacement Product or repair will be provided. You are solely responsible for shipping and handling costs to return the Product to Trinity. Trinity strongly encourages you to use a shipping method that includes tracking or delivery confirmation. Please note that you are responsible for all shipping costs and bear the risk of loss or damage during transit until the Product is received and signed for by Trinity. Trinity is not responsible for lost or damaged returns sent by you. The cost of return shipping to you for Products determined by Trinity to be not covered by this Limited Warranty shall be your responsibility, and Trinity may require pre-payment of shipping charges before we return any such Product. Original purchasers returning Products for repair or replacement will be subject to age-verification. 

ALL PRODUCTS MUST BE CLEARED AND CLEANED OF ANY RESIDUE BEFORE BEING SHIPPED BACK TO A TRINITY FACILITY FOR FURTHER EVALUATION. If Products are mailed to Trinity uncleaned, Trinity will, in its sole discretion, either dispose of the Product, charge a $100 cleaning fee before returning the Product, or returned at your expense.


How Will Trinity Make Things Right?

If a valid warranty claim is made (as provided in the immediately following section) during the Limited Warranty Period, Trinity will repair or replace, at its option, any defective Product free of charge. Replacement Products may be a refurbished or a reconditioned Product of the same model. 

Note: Product color is subject to availability and is at the sole discretion of Trinity. Personalized/engraved or limited-edition Products will be replaced with a standard/non-engraved Product.

All Products and parts that are replaced become the property of Trinity. Trinity can only ship replacement or repaired Products to the country where the original Product was purchased.

Except as stated herein, Trinity makes no other express warranty.


What Should I Do If I Think My Product Is Defective?

If you have a question about your Product or believe a Product is defective, please go to https://www.mytrinitypods.com/pages/support or call us at (855) 753-6308. You will find lots of online support tools and information to help you with your Product. 

To request service under this Limited Warranty, the Product must be registered. Contact Trinity at support@www.mytrinitypods.com or www.mytrinitypods.com/warranty, and a Trinity representative will provide instruction on how to proceed. 

To make a claim under the Limited Warranty, you must also obtain an RMA number from Trinity Support before returning a Product. Products returned without an RMA number are not processed and will be returned to you (at your sole cost and expense) or destroyed. 

If Trinity issues an RMA number, you must provide the defective Product and a copy of the original receipt of purchase to Trinity for inspection. The receipt of purchase must indicate the Product purchased, price paid, date of purchase, and name of the Trinity Store at which the Product was purchased. 

DO NOT SHIP ANY PRODUCT TO TRINITY WITHOUT PRIOR AUTHORIZATION. THE TRINITY CUSTOMER SUPPORT TEAM WILL ISSUE AN AUTHORIZATION CODE IF A WARRANTY CLAIM IS VALID.


Returns must go to the address included on the return label or provided by Trinity Support. If Product are returned to any address other than the specific address provided by Trinity Support, Trinity cannot guarantee that the Product will be located and processed for warranty support. 

Please return only the part specifically requested by Trinity Support, not the entire Product. 


Counterfeiting.

The fight against unauthorized and counterfeit Products is a long-term commitment to quality and service by Trinity. Trinity advises purchasers to be cautious when purchasing a Product from unauthorized resellers or unauthorized retailers. Trinity does not provide warranty service for Products purchased from an unauthorized reseller or unauthorized retailers. While Trinity would like to help the victims of counterfeiting, we are not able to reimburse money used to purchase infringing or counterfeit goods, nor do we assist with the resolution of disputes.


Battery Disposal. 

Batteries and electronic components should be disposed of in accordance with local recycling and hazardous waste regulations. Contact your local waste management authority for guidance.


General Exclusions And Limitation Of Liability.

IN THOSE JURISDICTIONS WHERE IT CAN LAWFULLY DO SO, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TRINITY GROUP, ITS RESELLERS AND ITS SUPPLIERS HEREBY DISCLAIM AND EXCLUDE ALL OTHER WARRANTIES DIFFERENT FROM THIS LIMITED WARRANTY, EXPRESS, STATUTORY OR IMPLIED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE TRINITY GROUP, A DEALER, AGENT OR AFFILIATE, SHALL CREATE A WARRANTY DIFFERENT FROM THIS LIMITED WARRANTY. TO THE EXTENT WARRANTIES CANNOT BE DISCLAIMED OR EXCLUDED, THEY ARE LIMITED TO THE DURATION OF THE RELEVANT EXPRESS LIMITED WARRANTY PERIOD.

EXCEPT AS PROVIDED IN THIS LIMITED WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE TRINITY GROUP BE LIABLE FOR ANY DIRECT, INDIRECT, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF THE TRINITY GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE TRINITY GROUP TO YOU FOR ALL DAMAGES EXCEED THE PRICE YOU PAID FOR THE PRODUCT. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF ANY WARRANTY OR REMEDY PROVIDED FAILS OF ITS ESSENTIAL PURPOSE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, OF LIABILITY FOR INJURIES, OR OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.

Some JURISDICTIONS do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

THE LAWS OF THE STATE OF FLORIDA GOVERN ALL MATTERS ARISING OUT OF THIS AGREEMENT, EXCLUDING RULES OF CONFLICTS OF LAW THAT WOULD RESULT IN THE CHOICE OF ANOTHER JURISDICTION’S LAWS.
